Procurement Method to be Selected (Section -8)

Sub-Section 1

A public entity shall apply any of the following methods based on such conditions and purchase price as may be prescribed while procuring

  • For Procurement of Goods, construction works or other Services:
  1. By inviting open bids at international level
  2. By inviting open bids at national level: for procurement of construction works at one stage level of more than Rs 2 crores to 1 Arab
  3. By inviting sealed quotations: for procurement of goods, construction works or any services upto 20 lakhs according to approved program and procurement plan
  4. By Procuring directly: For procurement of Goods, Construction works or services upto Rs 5 lakhs (procurement of medicines upto 20 lakhs or goods produced in Nepal upto 15 lakhs by producing a notice in a national level newspaper by the manufacturer of such goods can be procured directly (section 85))
  5. through participation of users committee or beneficiary group : for procurement of construction works or services relating to it upto Rs 1 crore by person residing at that place or consumer community or beneficiary community utilizing such service
  6. Through Force Account
  7. Through lump sum method: for procurement of construction work upto Rs 2 crore where no qualification is required
  8. Catalogue shopping : for procurement of heavy equipment, vehicle, machinery equipment, X-ray, MRI etc.
  9. Limited Tendering: For procurement of any goods, construction works, consultancy services or other service available in limited supply
  10. Buyback method: for exchange of vehicle, machinery, equipment, chemical fertilizer, pesticide etc. owned by the public entity whose date has been expired by the manufacturer or supplier
  11. 

  • Procurement of Consultancy services :
  1. By requesting competitive proposals
  2. through direct negotiations : for procurement of consultancy services upto 5 lakhs only for training, seminar etc by the chief of public entity. amount exceeding 5 lakhs to Rs 20 lakhs can be procured directly by the approval of one level higher authority by obtaining at least 3 quotations

Sub-Section 2

In making procurement as per this act, the procurements shall not be made in fractions to avoid competition
