Section 5A of The Public Procurement Act

Sub-Section 1

A public entity shall have to approve particulars pursuant to

section 4
and cost estimate pursuant to
section 5
as prescribed



Sub-Section 2

  • if the cost variation exceeds 25% of the initial cost estimate or
  • the procurement proceeding is affected due to the erroneous design or preparation of abnormal cost estimate

the officer involved in design, preparation of cost estimate, checking or approval and consultant involved in such work shall be liable to punishment pursuant to prevailing laws
