Qualification of a Bidder or a Proponent

A bidder shall have to fulfil the following qualification in order to obtain a procurement contract
- In the case of a bidder, the qualification criteria set forth in the bidding documents or where pre-qualification proceedings have been conducted, the criteria set out in the prequalification documents
- In the case of a consultant, the qualifications set out in the documents relating to proposals
Sub-Section 2
The following criteria may be set forth while setting forth the qualification criteria pursuant to sub-section 1.
- Professional and technical Qualifications
- Equipment Availability
- Past Performance
- after-sale service arrangements
- availability of spare parts
- legal capacity
- financial resources and conditions
- punishment for having committed professional offences
- other similar criteria
Sub-Section 3
In setting forth the qualification criteria as pursuant to sub-section 2, no provision shall be made so as to allow only a particular class of construction trader, supplier, consultant or a supplier to participate or to prevent any other class of such to participate in the procurement process
Sub-Section 4
Bids, Pre-Qualification proposals and Consultancy proposals shall only be evaluated in accordance with the criteria set forth in the bidding documents, pre-qualification documents or proposals and such criteria shall be equally applicable to all the bidders or proponents without any discrimination
Sub-Section 5
Construction works with a cost estimate of upto 20 million (2 crores) | No qualification documents shall be prescribed |

Sub-Section 6
if the documents submitted by a bidder concerning the qualifications are factually false or substantially incomplete, the PE may disqualify the bidder.
provided that minor errors can be corrected by seeking information pertaining thereto from the concerned bidder or proponent
